Terms and Conditions

This document sets the rules for using the www.thescene.social platform and the terms governing participation in events organized by The Scene. By accessing our website, applying for membership, purchasing a ticket, or simply attending an event, you confirm that you have read, understood, and fully agree to these Terms and Conditions. If you do not agree with any of the provisions below, please stop using our services immediately.

1. Acceptance of Terms
By accessing the website thescene.social, applying for membership, purchasing a ticket, or attending any event organized by The Scene, you automatically accept these Terms and Conditions in full. If you disagree with any of them, we kindly ask that you refrain from using our platform or participating in our events.

2. Service Provider
The events and platform are provided by Mozaik Social S.R.L., located at Strada Păcii no. 1, room 1, Constanța, Romania, company ID 46888616. All references to “we,” “The Scene,” or “the Organizer” refer to this company.

3. Eligibility and Membership Status
Membership is free but strictly selective. Only individuals aged 18 or older may apply. The Organizer reserves the right to accept or reject applications at its sole discretion, with no obligation to provide justification. Members are expected to maintain respectful behavior and comply with these rules in order to keep their membership status.

4. Tickets, Refunds, and Transfers
For each event, an electronic ticket is issued via Stripe. Ticket prices currently do not include VAT, as the Organizer is not, at the date of this version, a VAT-registered entity. Unless otherwise stated on the event page, full refunds can be requested up to five calendar days before the scheduled event. After this deadline, tickets are non-refundable. Tickets can only be transferred to another active member of The Scene via the official process provided by the Organizer. Unauthorized resale of tickets on any platform is strictly prohibited, and the Organizer reserves the right to cancel any such tickets without compensation.

5. Event Conduct
Participants are expected to dress appropriately and behave respectfully. Harassment, aggressive behavior, illegal substance use, or any other action that disrupts the experience of others is not tolerated. The Organizer may immediately remove anyone who violates these rules, without refund or further liability.

6. Risk Activities and Disclaimer
Some events may include inherently risky activities such as yacht parties, excursions, or outdoor experiences. Participation is entirely voluntary and at your own risk. The Organizer is not responsible for injuries, losses, or damages arising from failure to follow safety instructions or the consumption of alcohol or other substances.

7. Intellectual Property
The name “The Scene,” its logo, and all visual, audiovisual, or written materials associated with its events are the exclusive property of Mozaik Social S.R.L. Any reproduction, distribution, or use of this content, in whole or in part, is prohibited without written permission from the rights holder.

8. Future Products, Subscriptions, and Services
The Organizer may launch merchandise or paid subscription services in the future, offering extended benefits. Commercial terms, pricing, and cancellation policies for these services will be published on our website when introduced and will either supplement or override relevant parts of these Terms accordingly.

9. Force Majeure
The Organizer is not liable for failure to perform or delays caused by force majeure events such as pandemics, extreme weather, government actions, or other circumstances beyond reasonable control. In such cases, if an event is cancelled, the Organizer may choose to either refund the ticket price or offer a voucher of equal value, with no additional compensation.

10. Limitation of Liability
To the extent permitted by law, the Organizer’s liability toward any participant or user is limited to the total value of tickets or fees paid by that individual for the specific event or service concerned. The Organizer shall not be liable for indirect losses, lost profits, data, or reputational damage.

11. Changes to the Terms
The Scene reserves the right to update these Terms at any time. The latest version will always be available on our website, along with the date of the last update. Continued use of the platform or participation in events after a new version is published implies acceptance of the updated Terms.

12. Governing Law and Jurisdiction
These Terms are governed by Romanian law. Any disputes arising out of or related to the use of The Scene’s services will be settled by the competent courts in Constanța, Romania.
